The responsibility of pedestrians to wear reflective vest

The year 2016 will probably bring several innovations in road law. In addition to the already known increase in speed allowance, on some sections of the 1st class road sections, the Department of Direction passed the third reading in the Chamber of Deputies another amendment, which, for example, regulates the pedestrian duties and extends the powers of the police.

Benefits for the driver do not bring this novelty much, so if you do not consider this to be the responsibility of pedestrians to wear reflective elements on clothing, if they are out of sight on the road outside the village. The goal here is to increase safety; the idea is that we will no longer meet pedestrians in black clothes going in the darkness of the road, because such a pedestrian can be seen for the last few meters. Failure to comply with such an obligation will result in pedestrians being fined up to two thousand crowns on the spot. Whether a pedestrian from a policeman "included" also gets a reflective tape on his sleeve is not known.

Allegedly, against the falling snow and ice from the roofs of trucks, the order is that the driver will have to clean the car from the snow and ice before going out on the road. A reasonable car driver does so now, and the regulation does not need it because he does not want to see the car out of the road. Whether a ladder and a long broom are added to the mandatory equipment of trucks, so as to remove snow from the roof, so the policeman can look up the roof, we do not know. Theoretically, however, you will not see a car on the road, out of which the snowy windshield of your windshield will flow. However, the word "theoretically" is essential.

The aforementioned extension of the police powers is that it will again be apprehended with the possibility to withdraw the registration certificate of the vehicle, the so-called small technical card, if the car is obviously in an unsatisfactory technical condition. He will allegedly be able to do so when he finds a "dangerous defect" in a roadside inspection. Examples speak of used tires or poorly functioning brakes, and the policeman will have to state the exact reason.

Used tires, more precisely those that have less than the prescribed tread depth, are already fined today, so the police are already carrying dips. However, how it will test the braking performance on the road will be interesting. Technical inspection stations have special measuring instruments for the brakes, and they will not carry the police cars with them anymore.

The goal is to not run dangerous cars on the roads. Such a goal can be understood, but for the same purpose the police have the authority to send the car to the MOT when their condition is deemed to be inadequate. The STK is the only place to judge whether or not a car is operational, so we have to drive every two years with our cars at our own expense.

The police in safety vest had the authority to withdraw ORVs before, so it is not a complete novelty. She disappeared 15 years ago and is now returning - and the policeman partly makes a judge. He also handles a tool that can be misused to pressure the alleged offender to pay a fine on the spot, even if he disagrees with it and wants to move the case to administrative proceedings. That we do not like such an extension of our powers in view of possible negative consequences, we certainly do not have to deliver.

On the contrary, he did not pass the proposal from the KDU-ČSL, who wanted the police to be able to seize even a driving license on the ground, even on the mere suspicion that the driver had committed an offense for which he was banned for more than half a year. "Occasionally, someone who is not very correct and could abuse the paragraph could be found," the ODS, responded to this proposal. This, of course, also applies to the abovementioned removal of the ORV and, in fact, to any police powers that give it the possibility of immediate punishment without the possibility of a review by an independent body with suspense effect.
